Greek Yachting Association (GYA) formed by leading Greek yachting professionals

A number of leading Greek yachting companies have announced the formation of a new yachting association, called the Greek Yachting Association (GYA), and the creation of a new Charter show earlier this week.

The GYA was setup by a number of Greek yachting professionals involved in the Charter, Brokerage, Management, Insurance and Construction of large yachts. Currently the GYA and its members represent over 90% of the crewed charter yachts in Greece under central agency agreement, which include many of of the most popular Greek flagged yachts available to rent (see selection below).

The objective of the association is to:

• maintain high standards of professionalism in charter, sales and yacht management; • closely cooperate with MYBA association as MYBA members and MYBA companies; • organise an annual charter yacht show for the Greek and foreign flag charter yachts, under Central Agency Agreement.

The first President of the GYA is Michael Skoulikidis, CEO of Atalanta Golden Yachts. The board members are Stefanos Macrimihalos, Aris Drivas, Ioannis Kourounis, Amelie Panagakos, Spiros Galanakis and Julie Kourouvani.

The GYA will hold its inaugural luxury yacht charter show, called the Mediterranean Yacht Show , from 3 to 7 May 2014 in the historic town of Nafplion. The new show will be open to both Greek and foreign flag charter yachts, which will be welcomed by international brokers, as it will be an opportunity for them to inspect a wider selection of luxury charter yachts available for charter in the Greek waters next summer, on behalf of their clients, as well as meeting their crew.

It is currently uncertain what will happen to the East Med Yacht Show , which is organised by the Hellenic Yacht Brokers Association (HYBA) and the Hellenic Professional Yacht Owners Association (HPYOA), which is scheduled to take place around the corner in Poros at the same time this year.

Welcome to the new and updated website of Hellenic Professional Yacht Owners Association (H.P.Y.O.A.)

This new design is intended to assist our Members to promote their Yachts and to find useful information about laws and legislation that govern Yachting in Greece.

Our Visitors have access to our Member's profiles and to the Yachts of their ownership.

The Hellenic Professional Yacht Owners Association (HPYOA), widely known as EPEST, is a non-profitable institution. Its Members are Greek owners of more than 4.000 professional yachts (manned or Bare-Boat), governed by the Greek law 4296/2022.

EPEST was established in 1974 with aim to study and plan the nautical tourism, the promotion of economic and professional interests of its members, the development of a spirit of cooperation, assistance and brotherhood between them as well as of every other actinity which would lead to the improvement of terms and conditions for the employment of their yachts, and to the freedom and safety of navigation. 

Hellenic Professional Yacht Owners Association help its Members to promote their Yachts and services.

All registered Members can add/update Yachts of their ownership, can edit their personal information and have access to the library of different laws and legislations that govern sea tourism in Greece.

The last two decades EAST MED YACHT SHOW stands as a premier showcase of luxury yachting and maritime excellence, attracting enthusiasts, industry professionals, and maritime aficionados from around the world.

Yachting in Greece

Greek Seas and coasts with the numerous advantages they have to offer, turned Yachting to be a very popular activity for both Greeks and foreign visitors.

A trip on the calm Greek waters, on your own or a chartered yacht, offers you the possibility to sail among extremely beautiful clusters of islands, to anchor in naturally protected bays of rare beauty, to visit inaccessible beaches and to swim with safety in exceptionally clear and transparent waters.

It is useful to divide the Greek seas into 4 zones running from North to South, and thus examine the course of the summer winds.

Winds vary greatly from zone to zone, (except when the meltemia winds are blowing, which are very strong, and result in large areas overlapping and having the same features).

Nowadays there are 19 marinas with 6,661 docking places in Greece, offering high quality services. Quite a few of these marinas have been awarded by the European Blue Flag programme. New modern marinas, hotel ports and moorings for the safe docking of boats already operate or are in the process of starting their operation, in order to meet the needs of tourists coming to Greece by sea in the most satisfactory way and under the safest conditions.

FIRST INSTALMENT (50% of the total charter fee) _________________ payable latest by _________________ SECOND INSTALMENT _________________ payable latest by _________________. The above amount to be deposited to the following BROKER’s Account and shall be deemed paid only when cleared:

CLAUSE 1 AGREEMENT TO LET AND HIRE

The OWNER agrees to let the Yacht to the CHARTERER and not to enter into any other Agreement for the Charter of the Yacht for the same period. The CHARTERER agrees to hire the Yacht and shall pay the Charter Fee, the Advance Provisioning Allowance, in the case he has agreed that the OWNER arranges the provisioning on his behalf, and any other charges, in cleared funds, on or before the dates and to the Account specified in this Agreement.

CLAUSE 2 DELIVERY

The OWNER shall at the beginning of the Charter deliver the Yacht to the Port of Delivery and the CHARTERER shall take delivery in full commission and working order, seaworthy, clean, in good condition throughout and ready for service, with full equipment, including up-to-date safety and live-saving equipment (including life – jackets for children if any, are part of the Charterer’s Party), as required by the Yacht’s registration authority and enabling the CHARTERER to use the Yacht as set out in Clause 13. The OWNER does not warrant her comfort in bad weather conditions for all cruises or passages within the Charter Area.

CLAUSE 3 RE-DELIVERY

The CHARTERER shall re-deliver the Yacht to the OWNER at the Port of Re-Delivery free of any debts incurred for the CHARTERER’s account during the Charter Period and in as good condition as when delivery was taken, except for fair wear and tear arising from ordinary use. The CHARTERER may, if he wishes, re-deliver the Yacht to the Port of Re-Delivery and disembark prior to the end of the Charter Period but such early re-delivery shall not entitle the CHARTERER to any refund of the Charter Fee.

CLAUSE 4 CRUISING AREA AND TIME

The CHARTERER shall restrict the cruising of the Yacht to within the Cruising Area and to within regions in the Cruising Area. The CHARTERER shall also restrict time under way to an average of six (6) hours per day, unless the Captain, in his sole discretion, agrees to exceed this time or unless otherwise is agreed among the Undersigned Parties.

CLAUSE 5 MAXIMUM NUMBER OF PERSONS RESPONSIBILITY FOR CHILDREN HEALTH OF THE CHARTERER’S PARTY

1. The CHARTERER shall not at any time during the Charter Period permit more than the Maximum Number of Guests Sleeping or Cruising on Board here in stated. As an exception, a reasonable number of visitors could be on Board whilst the YACHT is securely moored in port and at the sole discretion of the Captain.

2. If children are taken on board, the CHARTERER shall be fully responsible for their safety, conduct and entertainment

3. The nature of a yacht charter may render it unsuitable for anybody with physical disability or undergoing medical treatment. By signature of this Agreement the CHARTERER warrants the medical fitness of all members of the CHARTERER’s party for the voyage contemplated by this Agreement. The CHARTERER and his party undertake to have all necessary visas and vaccinations for the countries to be visited.

CLAUSE 6 CREW

The ONWER shall provide the Crew of the yacht, according to the laws of Greece and properly uniformed, fed and insured. The OWNER shall ensure that the Captain and Crew comply with the laws and regulations of any country into whose waters the Yacht shall enter during the course of this Agreement.

CLAUSE 7 CAPTAIN’S AUTHORITY

1. The OWNER shall ensure that the Captain shows the CHARTERER the same attention as if the CHARTERER were the OWNER. The Captain shall comply with all reasonable orders given to him by the CHARTERER regarding the management, operation and movement of the Yacht, wind, weather and other circumstances permitting. The Captain shall not, however, be bound to comply with any order which, in the reasonable opinion of the Captain, might result in the Yacht moving to any port or place that is not safe and proper for her to be in, or might result in the CHARTERER failing to re-deliver the Yacht upon the expiration of the Charter Period, or would cause a breach of Clause 13.

2. Further, without prejudice to any other remedy of the OWNER, if, in the reasonable opinion of the Captain, the CHARTERER or any of his Guests fail to observe any of the provisions in Clause 13 and if such failure continues after the Captain has given due and specific warning to the CHARTERER in writing in respect to the same, the Captain shall inform the ONWER and the BROKER(s) and the OWNER may terminate the Charter forthwith or instruct the Captain to return the Yacht to the Port of Re-Delivery and upon such return the Charter Period shall be terminated. The CHARTERER and his guests shall disembark, the CHARTERER having settled all outstanding expenses with the Captain before hand and the CHARTERER shall not be entitled to be refunded any part of the Charter Fee.

3. With particular regard to the use of watersports equipment, as defined in Clause 16, the Captain shall have the authority to prohibit the use by the CHARTERER or any or all of his Guests from use of any particular watersports equipment if, in his reasonable opinion, they are not competent to operate such equipment, are behaving in an irresponsible manner, or are failing to show due concern for other persons when operating this equipment.

CLAUSE 8 OPERATING COSTS

The CHARTERER shall be responsible for the operating costs, as specifically defined under “CONDITIONS” on Page One of this Agreement, for the entire Charter Period for himself and his Guests. Having paid the Advance Provisioning Allowance (A.P.A.) via the BROKER’s Account, as required by this Agreement, the CHARTERER shall be advised by the Captain, at intervals, as to the disbursement of the A.P.A. and shall, if the balance remaining becomes insufficient, in the light of current expenditure, pay to the Captain, in cash, a sufficient sum to maintain an adequate credit balance. Prior to disembarkation at the end of the Charter Period, the Captain shall present to the CHARTERER a detailed account of expenditure with as many supporting receipts as possible, and the CHARTERER shall pay to the captain, in cash, the balance of the expenses, or the Captain shall repay to the CHARTERER, in cash, any balance overpaid, as the case may be.

Payment for special requirements or equipment, shore transport or excursions or any other expenses not customarily considered part of the Yacht’s operating costs may be required to be paid via the BROKER’s account in advance or to the Captain on boarding in addition to the A.P.A. Unless specific alternative arrangements have been made in writing, in advance, all payments for operating costs etc, shall be payable in cash in the same currency as the Charter Fee. Payment by cheque, credit card or other negotiable instrument is not acceptable due to the itinerant nature of the Yacht’s seasonal schedule and the CHARTERER should therefore ensure that he carries sufficient cash to cover all reasonably foreseeable expenses or arrange to deposit additional funds with the BROKER.

CLAUSE 9 DELAY IN DELIVERY

1. the OWNER fails to deliver the yacht at the Port of Delivery at the commencement of the Charter Period, the OWNER will allow the CHARTERER demurrage pro rate for every day or part of day lost or if it be mutually agreed the OWNER shall allow a pro rata extension of the Charter Period.

2. If by reason of force majeure the OWNERS fails to deliver the yacht within forty-eight (48) hours or a period equivalent to one-seventh (1/7th) of the Charter Period, whichever period is shorter, from the due time of delivery, the CHARTERER shall be entitled to treat this Agreement as terminated. The CHARTERER’s exclusive remedy will be to receive repayment without interest of the full amount of payments made by him to the OWNER or BROKER(s). Alternatively, if the parties mutually agree and subject to the bookings of the yacht, the Charter Period shall be extended for a period equal to that which shall have elapsed between the date of delivery and the date of the actual delivery of the Yacht.

3. If the OWNER fails to deliver the yacht at the Port of Delivery at the commencement of the Charter Period in accordance to article b of this clause, other than by reason of force majeure, the CHARTERER shall be entitled to treat this Agreement as repudiated by the OWNER The CHARTERER will be entitled to repayment without interest of the full amount of all payments made by him to the OWNER or BROKER(s), and shall in addition be paid by the OWNER liquidated damages, calculated and paid forthwith on the following scale (measure of the scale to be the date of acknowledge regarding the failure of on time delivery):

1. If the CHARTERER is informed three (3) months or more before commencement of the Charter Period, an amount equivalent to 7,5% of the Charter Fee.

2. If the CHARTERER is informed more than fourteen (14) days but less than three (3) months before commencement of the Charter Period, an amount equivalent to fifteen percent (15%) of the Charter Fee.

3. If the CHARTERER is informed less than fourteen (14) days before commencement of the Charter Period, an amount equivalent to twenty five percent (25%) of the Charter Fee.

4. Alternatively to the repayment of the full amount and the liquidated damages set forth in article c of clause 9, the OWNER may offer to the CHARTERER for the same Charter Period and Charter Fees another yacht upgraded to the yacht initially agreed to in regard to size, comfort and services. In the case of replacement of the yacht, this is agreed by the Undersigned parties if the CHARTERERS gives consent on this.

CLAUSE 10 DELAY IN RE-DELIVERY

1. If re-delivery of the Yacht is delayed by reason of force majeure, re-delivery shall be effected as soon as possible thereafter and in the meantime the conditions of this Agreement shall remain in force but without penalty or additional charge against the CHARTERER.

2. If the CHARTERER fails to re-deliver the Yacht to the OWNER at the Port of Re-Delivery due to intentional delay or change of itinerary against the Captain’s advice, then the CHARTERER shall pay forthwith to the OWNER demurrage at the daily rate plus forty percent (40%) of the daily rate, and if delay in re-delivery exceeds twenty-four (24) hours, the CHARTERER shall be liable to indemnify the OWNER for any loss or damage which the OWNER shall suffer by reason of deprivation of use of the Yacht or cancellation of, or delay in delivery under, any subsequent charter of the Yacht.

CLAUSE 11 CANCELLATION BY THE CHARTERER

1. Should notice of cancellation of this Agreement be given by the CHARTERER on or at any time before commencement of the Charter Period, or should the CHARTERER fail after having been given notice to pay any amount payable under this Agreement, the OWNER shall be entitled to retain the full amount of all payments made by the CHARTERER prior to cancellation.

2. Without prejudice to the OWNER’s remedies in (a) above, if the OWNER is able to re-let the yacht to another Charterer for all or part of the Charter Period and under the same conditions or reduced price then the OWNER or the BROKER on his behalf shall refund to the CHARTERER such net balance as is due to the CHARTERER after re-letting which is to be calculated upon the following basis:

The original Charter Fee, net of commissions, shall be deducted from the net hire for the Charter Period due to the OWNER from the re-letting. To this figure is to be added all reasonable additional expenses, including commissions, incurred by the ONWER on re-letting. The figure as calculated will be deducted from the monies actually received from the CHARTERER and any remaining credit balance due to the CHARTERER will be repaid. The intention is that the OWNER shall not receive less in net proceeds from any re-letting than would have been received if the original Agreement has been fulfilled. The OWNER shall use his best endeavors to re-let the yacht and shall not unreasonably withhold his agreement, to re-let, although charters, which may reasonably be considered detrimental to the yacht, its reputation, its crew or its schedule may be refused.

CLAUSE 12 BREAKDOWN OR DISABLEMENT

1. If, after delivery, the Yacht at any time is disabled by breakdown of machinery, grounding, collision or other cause so as to prevent reasonable use of the Yacht by the CHARTERER for a period of not less than twelve (12) consecutive hours or one-seventh (1/7th) of the Charter Period, whichever is the larger, and not more than forty-eight (48) consecutive hours or one-seventh (1/7th) of the Charter Period, whichever is the shorter, (and the disablement has not been brought about by any act or default of the CHARTERER), the OWNER shall make a pro rate return of the Charter Fee from the date and time when the Yacht was disabled or became unfit for use. Alternatively, if the parties mutually agree and subject to the circumstances, the Charter Period shall be extended by a time equivalent to the disablement. If the CHARTERER considers the circumstances justify the invoking of this Clause, he shall give immediate notice in writing to the Captain that he wishes to do so.

2. If, however, the Yacht is lost, or is so extensively disabled as aforesaid that the Yacht cannot be repaired within a period of forty-eight (48) hours or one-seventh (1/7th) of the Charter Period, whichever is the shorter, the CHARTERER may terminate this Agreement by notice in writing to the OWNER or the BROKER(s) or, if no means of communications is possible, to the Captain on the OWNER’s behalf, and as soon as practicable after such termination the Charter Fee shall be repaid by the OWNER pro rate without interest for that part of the Charter Period remaining after the date and time that the loss or disablement occurred. In these circumstances the CHARTERER may effect Re-Delivery by giving up possession of the yacht where she lies. The CHARTERER shall be entitled to recover from the OWNER the reasonable cost of returning himself and his passengers to the Port of Re-Delivery by scheduled services, together with any accommodation expenses necessary for this purpose.

3. Article a and b of clause 12 shall not be valid for time charters, where there are special clauses in the case of breakdown or disablement.

CLAUSE 13 – USE OF THE YACHT

1. The CHARTERER shall use the Yacht exclusively as a pleasure vessel for the use of himself and his Guests. The CHARTERER shall ensure that no pets or other animals are brought on board the Yacht without the consent in writing of the OWNER. The CHARTERER shall ensure that the behavior of himself and his Guests shall not cause a nuisance to any person or bring the Yacht into disrepute.

The CHARTERER shall comply, and shall ensure that his Guests comply, with the laws and regulations of any country into whose waters the Yacht shall enter during the course of this Agreement.

The CHARTERER shall ensure that any bonded stores or other merchandise which may already be aboard the Yacht, or may be brought aboard the Yacht during the Charter, are cleared through Customs before being taken ashore, if required by the laws and regulations. The Captain shall promptly draw the CHARTERER’s attention to any infringement of these terms by himself or his Guests, and if such behavior continues after this warning, the Captain shall inform the OWNER or his BROKER, and the OWNER may, by notice in writing given to the CHARTERER, terminate this Agreement in accordance with Clause 7 of this Agreement.

2. If the CHARTERER or any of his Guests shall commit any offence contrary to the laws and regulations of any country which results in any member of the crew of the Yacht being detained, fined or imprisoned, or the Yacht being detained, arrested, seized or fined the CHARTERER shall indemnify the OWNER against all loss, damage and expense incurred by the OWNER as a result, and the OWNER may, by notice to the CHARTERER, terminate this Agreement forthwith.

It is also specifically understood that the possession or use of any illegal drugs or any weapons (including particularly firearms) shall be sufficient reason for the OWNER to terminate the Charter forthwith without refund or recourse against the OWNER.

CLAUSE 14 NON-ASSIGNMENT

The CHARTERER shall not assign this Agreement, sub-let the Yacht or part with control of the yacht without the consent in writing of the OWNER, which consent may be on such terms as the OWNER thinks fit.

CLAUSE 15 SALE OF THE YACHT

Should the OWNER agree to sell the Yacht after the signing of this Charter Agreement, but before delivery to the CHARTERER, the OWNER shall immediately give notice of such sale in writing to the CHARTERER and the BROKER(s). Should the vessel be sold one of the following provisions will apply:

1. The OWNER shall arrange for the Buyer to take over the Charter Agreement and perform the Charter on the same terms and conditions by way of a new Charter Agreement between the involved parties. Shall the Charter not be perform on the same terms and conditions and with the same crew or Yacht of similar or superior standard, the CHARTERER is entitled to refuse signing of a new Charter Agreement.

2. If the Buyer is unwilling or unable to fulfill the Charter Agreement, the OWNER hereby procures the Charter of a replacement yacht of similar or superior standard and on the same Charter Fee. Shall the replacement Yacht not be of similar or superior standard, equivalent crew and expenses, then the CHARTERER is entitled to refuse the replacement Yacht.

3. Should the CHARTERER in accordance to article b of this clause, not sign a new Charter Agreement, or reject the proposed replacement, the CHARTERER will be entitled to repayment without interest of the full amount of all payments made by him, and shall in addition be paid by the OWNER liquidated damages, calculated and paid forthwith on the following scale:

The BROKER’s commission is deemed earned on the signing of this Contract and the OWNER shall pay the whole of the commission forthwith.

CLAUSE 16 INSURANCE

1. The OWNER shall insure the Yacht in accordance with paragraph 1 – clause 8 on N.2743/99 and specifically:

1. for urban liability for death, personal injury of Guests and third parties caused by collision, shipwreck or any other causes, and for an amount of at least three hundred thousand (300.000) Euro, regardless the number of persons.

2. for third parties liability for material damage to Guests and third parties caused by collision, shipwreck or any other causes, and for an amount of at least one hundred and fifty thousand (150.000) Euro

3. for sea pollution and with insurance of at least ninety thousand (90.000) Euro.

2. Additionally, the OWNER shall have insurance coverage against liabilities caused by the use of watersports equipment, as per paragraph 3 in clause 7 of this Charter Agreement. The insurance shall also cover war and strikes and include insurance of Crew against injuries and/or Third Party liabilities incurred during the course of their employment.

3. All such insurances (a & b) shall be on such terms and subject to such deductibles as are customary for a vessel of the Yacht’s size and type. Copies of the relevant insurance documentation shall be available for inspection by the CHARTERER prior to the Charter on reasonable notice to the Captain, and shall be carried on board the Yacht.

4. The CHARTERER shall carry independent insurance for Personal Effects whilst on board or ashore and for any Medical or Accident expenses incurred other than as covered under the Yacht’s insurance as per I and II of clause 16. It is also agreed that Cancellation and Curtailment insurance is not included in this Agreement.

CLAUSE 17 – CHARTERER’S LIABILITY

The CHARTERER shall only be liable for such costs or losses as may be incurred by repairing damage caused by the CHARTERER or his guests (intentionally or otherwise) to the Yacht or any third party up to the level of the Excess (Deductible) on the OWNER’s insurance policy for each separate accident or occurrence.

The CHARTERER may be liable for a sum greater than the Excess (Deductible) on any one accident or occurrence if the CHARTERER or any of his guests acted in such a manner (intentionally or otherwise) as to avoid, or limit, the coverage under the OWNER’s insurance.

CLAUSE 18 DEFINITIONS

1. FORCE MAJEURE

In this Agreement “force majeure” means any cause directly attributable to acts, events, non-happenings, omissions, accidents or Acts of God beyond the reasonable control of the OWNER or the CHARTERER (including, but not limited to, strikes, lock-outs or other labor disputes, civil commotion, riots, blockade, invasion, war, fire, explosion, sabotage, storm, collision, grounding, fog, governmental act or regulation, major mechanical or electrical breakdown beyond the crew’s control and not caused by OWNER’s negligence).

2. OWNERS, CHARTERERS AND BROKERS

Throughout the Agreement, the terms “OWNER”,“CHARTERER” and “BROKER” and corresponding pronouns shall be construed to apply whether the OWNER, CHARTERER or BROKER is male, female, or corporate, singular or plural, as the case may be.

CLAUSE 19 ARBITRATION

Any dispute in connection with the interpretation and fulfillment of this Agreement shall be decided by arbitration in Piraeus, Greece. Each party shall appoint one Arbitrator, the third –in head of the arbitration – being appointed by the Shipping Chamber of Shipping in Greece. This Agreement shall be interpreted and fulfilled in accordance with the laws of Greece and the Courts of Piraeus/Greece.

CLAUSE 20 BROKERS

1. The BROKER’s commission shall be deemed to be earned by the BROKER(s) upon the signing of this Agreement and be payable by the OWNER on the full Charter Fee and sectionally in accordance to the payments of the Charter Fee. In the event of Cancellation or Curtailment by the CHARTERER, the commission shall be deducted as an expense from the deposit and in the case of cancellation by the OWNER the commission will be payable by the OWNER.

2. If the CHARTERER should extend this Charter or should re-charter the Yacht from the OWNER within two (2) years from the date of completion of this Charter whether or not on the same terms, then the BROKER(s) shall be entitled to, and shall be paid by the OWNER, commission on the gross Charter Fee paid for that further charter upon the same basis as provided herein.

The OWNER shall not be obligated to pay commission to the BROKER(s) in case of re-charter under the following conditions:

1. In the case a license in accordance to the Greek legislation is involved.

2. The commission has been agreed

3. The payment of the commission is proved with legal documents.

If a lesser commission has been agreed to, then the BROKER of the initial Charter Agreement is entitled to be paid by the OWNER the difference arising from the application of the two different brokerage commissions.

3. If any agreement should be reached directly between the CHARTERER and the OWNER for the purchase of the yacht within two (2) years from the date of completion of this charter then the BROKER(s) shall be entitled to and be paid by the OWNER the customary or normal brokerage commission.

4. The BROKERS in this Agreement shall have no responsibility for any loss, damage or injury or even death to the person or property of the OWNER or CHARTERER or any of their Guests, servants or agents.

CLAUSE 21 PAYMENT OF THE CHARTER AND OTHER MONIES TO THE OWNERS

All funds received by the BROKER(s) against this Agreement shall be paid to the OWNER upon commencement of the Charter. The Advance Provisioning Allowance (A.P.A.) shall be paid to the OWNER before commencement of the Charter and in duly time in order that the Yacht can purchase provisions as per CHARTERER’s instructions.

CLAUSE 22 COMPLAINTS

The CHARTERER shall give notice of any complaint in the first instance to the Captain on board and note shall be taken of the time, date and nature of the complaint.

If, however, this complain cannot be resolved on board the Yacht then the CHARTERER shall give notice to the OWNER or to the BROKER on the ONWER’s behalf as soon as practicable after the event giving rise to the complaint has taken place and anyway within twenty-four (24) hours of the event or occurrence unless it is impracticable due to failure or non-availability of communications equipment. The complaint may be made verbally in the first instance but shall be confirmed as soon as possible in writing (by fax, telex or mail) specifying the precise nature of the complaint.

CLAUSE 23 NOTICES

Any notice given or required to be given by either Party to this Agreement shall be communicated in any form of writing and shall be deemed to have been properly given if proved to have been dispatched pre-paid and properly addressed by mail or bona fide courier service or by fax or telex, in the case of the OWNER, to him or to the BROKER at their addresses as per this Agreement or, in the case of the CHARTERER, to his address as per this Agreement or, where appropriate, to him on board the Yacht.

CLAUSE 24 ADDITIONAL CONDITIONS (if any)

A trip on the calm Greek waters, on your own or a chartered yacht, offers you the possibility to sail among extremely beautiful clusters of islands, to anchor in naturally protected bays of rare beauty, to visit inaccessible beaches and to swim with safety in exceptionally clear and transparent waters.

Arrival on a privately owned vessel (foreign flag) Before arriving in Greece on your own vessel bearing a foreign flag, you should obtain information on the basic regulations in force concerning entry and exit, as well as the formalities required.

Yacht chartering procedure When chartering a yacht, you should know: – what type of yacht you are interested in; – if you wish to have a crew on the yacht or not; – the number of people to be accommodated on the yacht; – the number of days and the exact dates of your trip; and – the departure port.

Charter contract

Cancellations.

The cost of chartering depends on the size of the yacht, the accommodations, the degree of comfort and the service required. Maximum rates are quoted for the high season, that is June to September, but reduced rates may be obtained for other months.

The base price agreed upon in the charter for a yacht, usually includes all yacht running costs, and wages and provisioning for the crew.

In some cases, depending on the type of vessel and the season, they may also include fuel and lubricants (e.g. sail boats and powerful-engine sailing boats.), or these may be charged extra (e.g. motorboats), while they may include water and port dues for a set time of sail. The daily price does not include the cost of food, drinks, refreshments, cleaning and any other demand made by the charterer. The costs of the Corinth Canal dues (if the vessels pass through that) and port dues for foreign ports are also charged extra.

In practice, it is accustomed for the boat broker/or owner to make a separate arrangement to supply foodstuff at an agreed daily rate per person. In the case of bare boats, the chartering terms are different from those of manned boats. The charter price only includes the chartering of the boat and insurance. A deposit is required against any eventual loss of equipment or damage, which is refunded immediately if the yacht is returned in its initial condition. The skipper wages (if required) are not included.

Charterers of bare boats usually buy their own food and drink, but the owner or yacht broker will, on request, arrange for supplies at local prices to be placed on board in readiness before the departure of the vessel.

In order to book a vessel, a charter contract needs to be signed between the contracting parties. This is a form in quintuple, approved by the Ministry of Merchant Marine, and specifying the terms of the charter (charge, deposit, date and harbors of departure and return). This contract is signed by both contracting parties, and a deposit is paid to the owner or to the broker, while the remainder must always be paid before the departure of the vessel.

Charter agreement V.A.T.

With regards to charter agreements of professional recreational vessel, V.A.T. (24%) is set as follows:

  • Tourist vessels on international cruises that go beyond Greek waters, when they have proof of having entered a foreign port, are exempt form V.A.T.
  • Tourist vessels on international cruise that go beyond Greek waters, when there is no evidence that they have entered a foreign port, are entitled to a V.A.T. discount of 60% (Category I).
  • Tourist vessels departing from a Greek port and going on long domestic cruise (e.g. Piraeus – Corfu – Northern Greece – Mytilini – Crete – Dodecanese) are entitled to a V.A.T. discount of 50% (category II).
  • Tourist vessels departing from a Greek port and going on short domestic cruises (e.g. Piraeus to Cyclades, N.Sporades, Zakinthos, Kefallonia, Corfu) are entitled to a V.A.T. discount of 40% (Category III).
  • Tourist vessels going on very short domestic cruises (e.g. Piraeus to Saronikos Gulf and Argolikos Gulf harbours or form the harbours of the N.and S.Evoikos Gulf to Volos or between Kornthiakos harbours and Patras) are charged with 24% V.A.T.

YACHT INVENTORY LIST

Together with the charter agreement, the inventory list is also signed, according to which the broker/or owner “charges” the charterer for all the equipment mentioned in said list.

If, for whatever reason, the charterers cancel their booking, the initial deposit is withheld by the yacht owner. However, in case the yacht owner is able to charter the vessel under the same terms and for the same dates, it is customary that he returns the deposit (minus the expenses incurred by the yacht owner), although he is not required by law to do so.

By mutual agreement, the charterer may use the boat later during the same season, or in the next, whenever it becomes available.

The charter must include full insurance cover for the vessel, the crew and any accidents caused directly by the negligence of the skipper or the crew or by defects in the vessels.

Charterers must arrange their own insurance coverage against illness or accidents arising out of their own negligence or misfortune.

It is preferable that bookings are made through members of the various associations of brokers, owners and licensed travel agents. In order to protect charterers, the Greek government requires yacht brokers to be licensed by the Greek National Tourist Organization, and to deposit a bond to ensure proper performance. This is not the case with owners. In all cases, however, it is required that all charter agreements be made on the official form prescribed by Greek law.

SOME PARTICULARS OF GREEK LEGISLATION

  • The right to charter “professional” recreational vessel under Greek flag belongs solely to yacht owners, operators and brokers.
  • It is prohibited for recreational vessel under foreign flag to be chartered from Greek harbours or to take on passengers for a fee. The same applies to vessels under Greek flag that are not licensed as “professional”.
  • Recreational vessel under an EU member-state flag or the flag of state of the European Economic Area and European Free Trade Area, excluding Switzerland, may be chartered on a total charter basis only between Greek ports on the coasts of mainland Greece, without approaching island ports. They can approach island ports only of they exceed 650 G.T. Another exception is made in special circumstances and only by special license granted by the Minister of Merchant Marine, under certain conditions. The exception applies to all foreign flag vessels.
  • For charters arranged abroad, the first Greek harbour sailed into is considered to be the first departure harbour.
  • Any chartered vessel must, prior to sailing from the departure harbour and for each cruise, be furnished with a copy of the charter agreement, certified by the Port Authority, where a copy will be deposited.
  • Before each sail, the skipper is required to deposit with the local Port Authority a list with full data of the crew and the passengers, a certified (by the Port Authority) copy of which he must carry on board, together with all other documents of the vessel, throughout the cruise.

The Aegean Sea winds usually appear during the warm season, i.e. from May to September, blow in a northward direction and are called etisies or meltemia. Normally, the meltemia season begins around the end of May and ends around the end of October. They are the strongest during the months of July and August, and their average duration is from 2 to 4 days, although they do not have the same frequency of appearance every year. These winds mostly blow during the day, from 8 in the morning to 8 in the evening, and are at their strongest around 2 in the afternoon.

They are characterized by alternate strengthening and weakening, while they fall quickly after sundown, to return at dawn. In the Northern Aegean they usually are NE winds, in the central Aegean they become North, and in the Southern Aegean NW. In the area of Rhodos they tend to become West, while in the Saronikos and the Northern Evoikos Gulf they remain NE. Under the influence of the sea breeze during the day, the meltemia become stronger locally, as it is the case in the coastal area of Northern Crete. The meltemia are at their most intense in the N.Aegean, particularly in the region of the Cyclades islands.

During the winter, the winds blowing in the Aegean reach a force of 8-9 Beaufort, while greater intensity is observed in the Kafireas straits (Cavo Doro) and in the Cyclades.

With regard to the waters in the Thermaikos Gulf, there we encounter the strong local NW wind called Vardaris, with strengths that range from 6 to 8 Beaufor. Also during the winter, and particularly when it is at its coldest, a humid wind in the Aegean region, which becomes gradually stronger, accompanied by low skies and rain. It appears mostly in the southern and western regions of the Aegean, but this stormy wind does not make an appearance often.

The winds blowing in the Ionian Sea during the summer are the NW “maistros” winds, while during the winter we also have the wet sirocco that, when at its strongest, can blow for 2 or 3 days without stop. Also during the winter, and to a lesser extent in the summer, blows the NE Central Mediterranean wind called “gregos”, which comes form Albania and Western Greece. It creates strong waves in the winter, but does not blow in the summer.

It is useful to divide the Greek seas into 4 zones running from North to South, and thus examine the course of the summer winds.

Winds vary greatly from zone to zone, (except when the meltemia winds are blowing, which are very strong, and result in large areas overlapping and having the same features).

More specifically:

THE FIRST ZONE  includes the Ionian Sea and the West Coasts of the Peloponnese. For the greater part of the summer, the North Ionian features light to medium NW winds, the maistros, which appear in the early afternoon and usually fall during sundown.

THE SECOND ZONE  is the sea area that is located south of Attiki and east of the Peloponnese. Very often in this area we have the southerly (SE) sirocco wind, the duration of which is usually short. The sea in the north part of this zone is protected from the strong northern winds by the land areas. In early summer there often is no wind at all, or weak winds blow, generally from the south. However, from July till the end of the summer, in this zone we mostly have meltemia, except for thw NW Peloponnese, where you may have encounter western winds.

THE THIRD AND CENTRAL ZONE  covers the greater part of the Aegean from North to South, including the Sporades and the Cyclades. Throughout the summer, the prevailing winds are northeaster winds in the Northern Aegean, and northwestern winds in the Southern Aegean. The meltemia are weaker during May and June, stronger during July and August, but disappear in the fall, when the high Balkan barometric pressures are decrease. These are not cold winds, but they may blow continuously for 3 to 4 days in a sunny sky, reaching an intensity of force 6 and in some case 7 to 8 on the Beaufort scale. They create sudden waves that may make conditions difficult for small recreational vessels, particularly in the sea areas around the island of Icaria and the Cavo Doro, north of Andros.

THE FOURTH ZONE , comprises the sea areas of the NE Aegean, as well as the sea of Samos and Kos before the coast of Turkey, is considerably influenced by the meltemia, particularly in the north. However, during the grater part of the summer a slight, variable breeze blows on the coasts of the southern region.

Marinas - Moorings

Marinas – Moorings

Nowadays there are 19 marinas with 6,661 docking places in Greece, offering high quality services. Quite a few of these marinas have been awarded by the European Blue Flag programme. In recent years, the Greek National Tourist Organisation and some of the 13 administrative regions of the country have started the implementation of a programme for the creation of an integrated network of anchoring and relevant services for boats along the Greek coasts; this programme is now nearing completion. New modern marinas, hotel ports and moorings for the safe docking of boats already operate or are in the process of starting their operation, in order to meet the needs of tourists coming to Greece by sea in the most satisfactory way and under the safest conditions. Moorings In addition to the docking places provided by public or private marinas, approximately 3,000 yachts can be accommodated in the Greek ports. Apart from the big commercial ports of Piraeus and Thessalonica, small and picturesque moorings have been created and equipped in many Greek ports. Piers and sea walls have been constructed, creating safe areas where yachts can dock, provided they pay the relevant port dues. Basic facilities and elementary services are provided in most of these ports for the docked boats. Such ports have been created in Mikrolímano of Piraeus, on the islands of Aegina, Poros, Hydra, Spetses, in Nafplio, Gythio, Pylos, on the islands of Zákynthos, Ithaca, Kefaloniá, Lefkada, Paxí, Ios, Mykonos, Patmos, Symi, Samos, Lesbos (Plomari), Chios and in other places.

-Port dues Commercial ports are supervised by the port authorities of each region. Yachts using the ports of the country are obliged to pay port dues as specified by the regulations of the competent Ministry of Mercantile Marine. The docking dues are paid at the Port Authorities of each region to the Port Fund and are calculated on the basis of yacht category, the metres of the yacht’s total length, the registered tons of total capacity and the duration of docking in the port.

-Supplies Fuel: Diesel fuel is provided to yachts in many ports of the country, mainly by fuel trucks, with the care of the port authorities of each region (information VHF, channel 12). Most oil companies have established a well-organised coastal network of fuel stations on the islands and the continental coasts of the country, capable of handling refueling requirements of yachts in each area. Moreover, some of these companies have built special small tankers, capable of carrying not only fuel, but fuel trucks as well, thus creating floating installations for the servicing of yachts. In the larger ports of the country fuel is charged at current prices. In more remote areas, however, a small surcharge is added in order to cover the additional transportation cost. Vessels are no longer entitled to transit fuel. All vessels, without exception, are obliged to use diesel fuel which has the natural yellow-white colour of oil (non coloured).

Gasoline: It is usually sold at gas stations and not at pumps near the pier.

Lubricants: Although all types of lubricants are sold in Greece, you may not find them on certain remote islands. For this reason, yachts on extended trips should have reserves of the lubricants they need.

Water: As far as the supply of potable water is concerned, at the marinas of the Greek National Tourist Organisation an additional charge of 80% is added to the urban consumption dues. Water is provided on the pier or is transported by road to the ports. It is recommended to check prices with the port authorities of the region. Due to water shortage on some islands during the summer, it may be difficult to replenish water supplies; therefore, skippers are advised to keep adequate water reserves on the boat.

Other supplies – provisions – equipment: As far as victuals, ice, gas and other goods are concerned, in most of the country’s ports you can buy these from private enterprises or through the organised networks of the oil companies (Information via the port authorities/VHF Channel 12).

-Repairs In most Greek coastal areas and near the ports of the mainland and the bigger islands, all types of wide-scale repairs are carried out and all kinds of service are provided to the boats. Some medium or small-scale repairs may be possible in the smaller ports and on the more remote islands.

-Please note the following regulations in force according to Greek legislation: 1. Private yachts, either under the Greek flag or under foreign flag, ARE NOT ENTITLED to tax-free delivery of equipment and supplies, such as fuel, lubricants, victuals and other goods. 2. Professional tourist ships ARE ENTITLED to tax-free delivery of fuel only, through the procedure by which the special oil consumption tax is returned for the amount of fuel that can be proven to have been used for professional reasons. Same vessels are not entitled to tax-free delivery of food supplies and other goods.

Note: The relevant legislation, which was recently revised in order to harmonise Greek legislation with European community policy, may be subject to differentiations with regard to these issues.

East Med Yacht Show 2024: Poros Port to Host 120 boats on Display

Greece’s annual East Med Yacht Show (EMMY’s) on Poros will see 120 boats on display this year and expects thousands of attendees throughout the four days its open, the event’s organizer, the Hellenic Professional Yacht Owners Association (HPYOA) , said on Wednesday.

Set to run from April 25 to 28 on the Greek island of Poros , the multihull yacht charter show is considered one of the largest events of the maritime industry and will see the participation of Greek and international yachting agents and media representatives that specialize in the international promotion of marine tourism .

In its 20th year, the East Med Yacht Show will feature the entire range of boats available for charter in the Greek market , including multihull crewed yachts, motor yachts, sailing yachts, catamaran and bareboats.

“I’m sure that the 20th East Med Yacht Show will be the largest to date and the most successful than ever,” said HPYOA President Antonis Stelliatos .

The event will host 45 exhibitors including boat charter companies (travel agents and freight brokers), as well as maritime tourism service providers. The exhibition section will be accessible to all visitors.

Moreover, the yacht show will welcome 350 brokers from the United States, Australia, Austria, Belgium, France, Germany, Switzerland, Greece, United Kingdom, Spain, Israel, Italy, Canada, China, Croatia, Cyprus, New Zealand, Poland and Turkey.

Speaking during the event, Greek National Tourism Organization (GNTO) Secretary General Dimitris Fragkakis highlighted the importance of the yacht show for Greek tourism.

“Τhe GNTO’s policy is to offer travelers many options… I believe this will be one of the best yacht shows ever,” he said.

During this year’s East Med Yacht Show, the GNTO will receive an accolade for the support it offers for the promotion of Greek maritime tourism.

Attendees at the East Med Yacht Show 2024 press conference included Barbara Gabriel, p resident of the yacht show’s organizing committee and CEO of FX Yachting; George Koutouzis,  the mayor of Poros; the president of the Port Fund of Poros, Konstantinos Moutzouvis; George Vernikos , Secretary General of the Greek Tourism Confederation (SETE); Vassilis Politis, member of the Board of Directors of the Hellenic Chamber of Shipping.

On her part, Barbara Gabriel, a renowned industry professional, highlighted the fact that Greek Prime Minister Kyriakos Mitsotakis has declared Poros as a “Green Island.”

“In this direction, yachting will make every effort and use all means to contribute to bioprotection,” she said.

On the sidelines of the press conference, HPYOA President Antonis Stelliatos announced that the 1st International Yacht Show for the purchase and sale of second-hand yachts will take place in October on Poros under the name SPYS (Sales & Purchase Yacht Show).

The 20th East Med Yacht Show is organized by the HPYOA in collaboration with FX Yachting, the Municipality of Poros and the Port Fund of Poros.

The event will be held under the auspices of the Shipping and Island Policy Ministry, the Tourism Ministry, the GNTO, the Region of Attica , the Hellenic Chamber of Shipping , the Piraeus Chamber of Commerce and Industry , the Federation of Greek Associations of Travel and Tourism Agencies (FedHATTA) , the Greek Tourism Confederation (SETE) , the Charter Yacht Brokers Association (CYBA), the Municipality of Poros , and the Propeller Club.
