About the Flag

Jersey is a British crown dependency but is not part of the UK or of the European Union. However, the UK Government is constitutionally responsible for its defense and international representation. It is one of the Channel Islands located in the English Channel between the UK and France. The British Register of Ships in Jersey is the largest Category 2 registry in the Red Ensign Group.

The island has specific tax, ownership and Social Security advantages for its ships and for crew employment contracts managed under Jersey Law. It is not part of the EU Social Security or VAT regimes. EU resident users may prefer to pay VAT on importation into the Union. Alternatively, temporary importation into the EU is available for all yachts for 18 months at a time. This makes the Jersey registry ideal for non-EU owners whether they wish to sail in EU waters or worldwide.

On 26 November 2013 the Shipping Register in Jersey took a major step towards being a fully open register – A new MOU with the United Kingdom’s MCA was been signed so that the Island can register commercial vessels, including workboats, up to 399 gt. (The previous limit was just 150gt). This followed an amending Order in Council made in May and local Jersey legislation passed in November. It is also the culmination of developments which have seen the appointment of the Island’s Marine Surveyor and agreements being reached with Recognised Organisations such as Lloyd's Register and RINA. The MOU lays down ship safety standards, quality objectives and a delegation matrix which are all in line with full Category 1 jurisdictions such as the Isle of Man and the Cayman Islands so this move lays the groundwork for future expansion should the Island want it. In the meantime, the advantages of Jersey as an efficient pragmatic British Register which lies outside the EU continue to be appreciated and the Registry has already seen growth of over 10% this year ahead of this expansion.

YACHT REGISTRATION — CHOOSING YOUR FLAG

If you’re considering purchasing a yacht , there’s a lot more to contemplate than simply where you’ll be cruising. Your choice of flag state, the nation where your yacht is registered one of the most important decisions you will make as a yacht owner.  Your choice of flag may affect the taxes you pay regarding the purchase and operation of your yacht, how your yacht is crewed, where it may sail and how often authorities may board and inspect your yacht.

Many European nations, and the United States, have onerous and labyrinthine maritime laws and codes. If you choose to charter out your yacht, this may complicate matters further as chartering means the yacht is under commercial vessel regulations; the rules of many ports demand different standards between private and commercial.

For the American yacht owner, there may be a sense of pride to fly Old Glory off the aft of the yacht, but US vessel documentation can cause some issues. Registering your yacht in a non-US jurisdiction can be part of the solution. That being said, there are some benefits to the US flag. If your yacht clocks in at less than 300 Gross Tons (a measurement based on interior volume, not weight), obtaining a US flag is fast and easy, particularly for yachts staying in US waters or cruising The Bahamas or Caribbean; it also is patriotic and cheaper for US-built yachts. But if you’re planning to cruise outside of the aforementioned areas, the benefits to a foreign flag may outweigh your patriotic leanings.

The Foreign Flag — What it means for your yacht registration

Most US and EU yacht owners choose to register their vessels under foreign flags. The flag of the vessel determines who is responsible for regulating and inspecting the vessel. The flag nation also determines under whose laws and jurisdiction the vessel operates (local port state laws may also apply). Due to this, most US and EU yacht owners prefer to register their yachts under jurisdictions that have streamlined taxation and registration procedures and lower tax rates, and also allow for multiple registrations of vessel names and owner anonymity.

British Commonwealth or “Red Ensign” nations are among the most popular flags for yacht registration. These nations are Bermuda, Gibraltar, Jersey, Guernsey, Turks and Caicos, Isle of Man, British Virgin Islands and the Cayman Islands. These jurisdictions are favored for their tax rates, ease of administration, favorable local corporate tax laws, and adherence to the Paris Memorandum of Understanding on Port State Control (Paris MoU).  They also allow the yacht to operate under the Temporary Import Regime (which allows a non-European owned vessel to operate for 18 months without the vessel being subject to custom duties or the EU’s Value Added Tax [VAT]).

The Marshall Islands & St Vincent & the Grenadines

Yachts with these flags have advantages similar to the Dutch registry, but these flags are better for pleasure yachting and charters based in the South Pacific. The flags are part of the Paris MOU White List, there are no taxes on operating profits, and they offer strong maritime support from maritime offices around the world.

Malta yacht registration is ideal for those who must remain registered under an EU flag but need relief from onerous VAT calculations. The Maltese flag is one of the most popular flags of registry for superyacht owners in the EU, as it is listed on both the Tokyo and Paris MOUs, the Maltese flag receives preferential treatment regarding port charges and taxes, there are no restrictions as to the nationality of the master, crew and officers of the vessel and the flag offers expedited service for registration and extensive yacht owner support.

Panama is an inexpensive alternative if you plan to sail primarily in and around the Caribbean. Panama has low tax and registration rates and offers corporate structures ideal for running a charter or other commercial related venture.

The Final Choice – Which Flag to Choose?

Each yacht owner’s situation is unique and, as such, you should consult with the appropriate maritime counsel and your yacht broker to ensure that your yacht flies a flag that makes the best sense for how you intend to use your yacht.

REPRESENTATION

Since 2004, individuals who are not ordinarily resident in Jersey or companies that do not have a principle place of business in Jersey are required to appoint a local representative, known as a Representative Person. The Representative Person can be an individual or a corporate body and must be based in Jersey. 

The Representative Person simple provides a legal link to the island, and provides a local address to which the register can legally serve papers should the owner be untraceable. Jersey Harbours will continue to correspond directly with the owner, the representative being a secondary contact. **

Change of Ownership, Amending Registration or Full Registration

The vendor must complete a bill of sale and the purchaser must complete a declaration of eligibility.

If the vessel is to be company owned, a copy of the Certificate of Incorporation must also be provided by the new owner and an appointment of authorised officer form. These forms must be returned to the Ships’ Registry with the Certificate of Registry, a copy of your passport (if individual ownership) and the prescribed fee.

Following the death of a registered owner, contact the Ships’ Registry for personal service.

Changing the name of a vessel

If you want to change the name of your currently registered vessel, you must complete an application form for change of name, and return it to the Ships’ Registry with the Certificate of Registry for amending and the prescribed fee.

Applying for a duplicate / replacement Certificate of Registry

If you have lost your Certificate or if it has become illegible, you may apply for a replacement by completing an application form and paying the prescribed fee.

If the vessel is owned by a company the form must be completed by the current nominated authorised officer.

Change an address / engine / authorised officer / representative person / managing owner / other particulars

You must complete the appropriate form and return it to the Ships’ Registry with the Certificate of Registry and the prescribed fee.

There is no charge for a change of address for individuals.

Apply for a transcript / copy of the register

Write, telephone, fax, or email the request to the Ships’ Registry, detailing the vessel’s name or official number with the prescribed fee and a return address for receiving the transcript.

Apply for a certified copy of a document

Contact the Ships’ Registry with the name of the document required and pay the prescribed fee.

Personally inspecting the register

The register is a public register and is available for inspection during normal working hours. A fee must be paid upon inspection.

Transfer port from / to Jersey

For transfer from Jersey, you must complete a request for transfer of port form and return it to the Ships’ Registry with the Certificate of Registry and the prescribed fee.

You must also contact the new REG port of registry in order to follow their requirements.

For transfer to Jersey, you must complete an application to register form, a declaration of eligibility form, and provide a copy of the Certificate of Incorporation if it is to be company owned.

You will also have to contact the current REG port of registry and ask them to send the relative information to the Ships’ Registry.

Transfers may be made within any of the REG registries:

  • Isle of Man
  • Cayman Islands
  • British Virgin Islands
  • Falkland Islands
  • Turks and Caicos

Keeping the registration of a vessel in another jurisdiction and registering in Jersey

This is only possible if someone else charters the vessel from you whilst you remain the legal owner.

This is known as ‘bareboat charter’ and to all intents and purposes the first registration is put into suspension.

The charterer registers the vessel in his own name and whilst on the Jersey register it will be subject to Jersey law. Contact the Ships’ Registry for further information.

Close a registration

You may request closure at any time by completing the request for closure form and returning it to the Ships’ Registry together with the Certificate of Registry for cancellation and the prescribed fee.

Apply for a closed transcript / certificate of deletion​

Anyone may apply for a closed transcript / certificate of deletion by contacting the Ships’ Registry and paying the prescribed fee. There is no specific form to request this.

There is however one register that stand out above all other flags as the best choice for nearly any yacht of any size and type – the British Register of Ships.

It is for good reason that the British Register of Ships is the number one internationally valid title register for yachts.

No other registry can offer the same combination of tradition, reputation, prestige and quality as the British Register of Ships.

The ‘Red Ensign’ flown by all British registered yachts is widely regarded as the flag of choice for the discerning yacht owner.

The British Register of Ships is divided into a number of separate shipping registries who collectively are known as the ‘Red Ensign Group’.

The Red Ensign Group is made up from the United Kingdom, the Crown Dependencies (Isle of Man, Guernsey and Jersey) and the UK Overseas Territories (Anguilla, Bermuda, British Virgin Islands, Cayman Islands, Falkland Islands, Gibraltar, Montserrat, St Helena and the Turks & Caicos Islands).

Any vessel registered in the UK, a Crown Dependency or UK Overseas Territory, is a “British Ship” and is entitled to fly the Red Ensign.

The registries forming the Red Ensign Group are divided into two categories:

Category 1 registers are capable of registering yachts of unlimited tonnage and type. Registers are:

Bermuda; British Virgin Islands (BVI); Cayman Islands; Gibraltar; Isle of Man; and United Kingdom.

Category 2 registers are capable of registering yachts and pleasure vessels of up to 150 gross tons (GT). This limit can be extended to 400GT with an agreement in place with the UK. Registers are:

Anguilla; Falkland Islands; Guernsey; Jersey; Montserrat; St Helena; and Turks & Caicos Islands.

What is the procedure to register a boat in Jersey?

The registration is easy and straightforward.
